Janesville man arrested for 5th OWI while getting more beer

A Janesville man may be regretting his decision to keep the party going.

The Rock County Sheriff’s Office says a deputy was investigating a traffic complaint near Jakes Mobile Gas Station on South Highway 51 just after 8:30 Tuesday evening when he observed a man stagger out of the business and walk toward a vehicle that was running in the parking lot.

The deputy made contact with the driver, who was identified as 42-year-old Michael Tracy.

Tracy admitted that he was intoxicated and that he drove to the gas station to get more beer.

The deputy says Tracy refused to submit to field sobriety tests, however a breath test at the jail revealed a blood-alcohol concentration of point-three-four.

Tracy faces a charge of felony fifth offense operating while intoxicated.
