Charges downgraded against Muskego man accused of being drunk during fatal crash in Rock County

The Rock County District Attorney’s Office downgrades the charges against a Muskego man who was under the influence of alcohol when he was the victim in a traffic accident that killed two people.

The Rock County Sheriff’s Office says about 3:30 (Sunday) afternoon, a 68-year-old man from Black river Falls was driving west on County N near North Vogel Road and drifted into the east bound lane hitting a pick-up head-on.

The 68-year-old man, and a 90-year-old female passenger were killed.

The Sheriff’s office says the driver of the pick-up, Jason Zembroski of Muskego was critically injured, and his passenger, a 43-year-old woman also hurt.

Although Zembroski didn’t cause the crash, because he was under the influence of intoxicants he was arrested on suspicion of two counts of homicide by intoxicated use of a vehicle, third offense OWI and two counts of OWI causing injury.

The Sheriff’s Office announced Monday afternoon that after consulting with the district attorney, the only charge that will move forward is a single count of third offense operating while intoxicated.
