Drunk driver will not be charged for bicyclist's death

A Clinton man accused of being drunk when he struck and killed a Beloit bicyclist will not be charged in the man's death.

The Rock County District Attorney's Office says that while 29-year-old Brett R. Hundley had a blood alcohol concentration of point-one-zero-six when he hit Mario Esquivel-Flores in the 2600 block of Milwaukee Road on August 29th, investigators believe the accident couldn't have been avoided.

A Beloit Police Department investigation revealed that Esquivel-Flores was wearing dark clothes at the time of the accident which occurred around 2:00 a.m. and that he didn't have any lights on his bike.  A witness had also reported seeing Esquivel-Flores swerving in an out of traffic prior to the accident.

Although Hundley isn't charged in Esquivel-Flores' death, he does face one count of operating while intoxicated with a prohibited alcohol content.

He's due in court Tuesday.
