Billy McCoy's lawsuit against City denied

A Janesville man who filed a lawsuit after the City Council ignored his direct legislation petitions to halt construction of the new Central Fire Station, and get voter approval for any projects cost more than $2 million may be licking his wounds.

About two months ago Billy McCoy dropped half of his lawsuit after work on the new fire station had progressed too far.

Then Friday Judge Daniel Dillion ruled in favor of the City of Janesville on the second part of the suit which would have required referendums any time the City wanted to spend more than $2 million on building projects.

Judge Dillon believed the ordinance would have violated the city's authority to regulate zoning and establish tax increment financing districts.
