(Gazette photo) A Rock County Judge denies a request for a temporary restraining order by the Monterey Dam Association which would have halted demolition of the dam that’s currently under way.
Judge Daniel Dillon questioned why plaintiff Jim Chesmore claimed irreparable harm when they only harm he would have would be monetary which is something the City could remedy in civil court.
At the heart of Dillon’s decision was another case in Rock County Court where the Monterey Dam Association sued the DNR for it’s decision to issue the permits to remove the dam.
Dillon said the Association could have asked the judge in that case to issue a stay on the permits but they failed to do so.
