A contentious child neglect case in Rock County may not be going to trial after all.
41-year-old Heather McCoy of Beloit is charged with six counts of neglect, including one resulting in bodily harm, but she says child protective services inaccurately reported the living condition of the children in her household.
She says many of the details in the criminal complaint filed against her are either false or embellished.
The complaint refers to Petitions for Protection or Services for six children in the home, which lists details of dirty clothes, animal feces on the floors, and flies swarming around an infant.
The complaint also says the children showed injuries and were malnourished.
McCoy says only four kids were actually taken from her, and the original complaint to Beloit police came from her estranged, mentally ill daughter.
She says child protective services doesn’t have enough evidence to take it to trial, but the court set a trial date in March for her and her husband Lakeidric McCoy during their court appearance Tuesday.
