A four-day homicide trial in Rock County court fails to reach an outcome as Judge Barbara McCrory declares a mistrial due to a hung jury.
The bailiff told the court the debate among jurors had become “toxic” after three hours of deliberation Wednesday night and another two and a half hours Thursday morning.
He said some jurors were no longer speaking to each other and moved to separate rooms.
Judge McCrory said she sent them home Wednesday night because “there were threats of physical violence being made” among the jurors.
22-year-old Julian Collazo of Janesville is charged with first-degree intentional homicide in the stabbing death of 43-year-old Christine Scaccia-Lubeck.
His attorney Jeff Jensen said Collazo will return to jail and await his next court date, which is scheduled for a calendar call on December 18.
District Attorney David O’Leary left the courtroom before reporters could ask him any questions.
