Janesville man avoids child pornography charges in separate sentencing agreement

A Janesville man receives a prison sentence after having his parole revoked from a business theft case.

47-year-old Michael Livengood won’t serve additional time behind bars because of his earned sentence credit, but he will spend two years on extended supervision after pleading guilty to theft of $25,000 from a customer of his repairman service.

Police reported that Livengood was paid in 2017 for work he never did, and he used the money elsewhere. The victims say they are still struggling from the financial loss.

District Attorney David O’Leary said Livengood violated his parole when he faced new potential charges of possession of child pornography earlier this year.

The district attorney’s office agreed not to prosecute him on those charges as part of a sentencing agreement for the theft case Wednesday afternoon.

Defense attorney Matthew Lantta said the child pornography case involved “extenuating circumstances”, and he noted Livengood has cognitive issues resulting from a traumatic brain injury and post traumatic stress disorder.
