Janesville Harley-Davidson dealership showing little progress in ongoing lawsuit

The owners of the Boardtracker Harley-Davidson dealership in Janesville don’t appear to be making much progress in the ongoing lawsuit against them from Harley-Davidson Credit Corporation.
Court records show the credit attorneys are not happy with what they call “highly misleading and nonresponsive representations” from the lawyer for Eric and Sara Pomeroy, who own Boardtracker and a second dealership in New Berlin.
They’re being sued for fraud in connection with loans they’re accused of not repaying.
The Pomeroys had previously reached an agreement to sell their New Berlin dealership, but a court filing from Friday says their relationship with the company managing that location has “deteriorated to the point where the agreement may be terminated.”
The attorneys for Harley-Davidson also filed a letter last week that said the Pomeroys “cannot be trusted to comply with this Court’s directive on providing an adequate and complete description of operations at Boardtracker.”
According to court filings, they are still talking to two different companies about the potential sale of both dealerships.
The Pomeroys are required to provide another update to the court on May 31.
Boardtracker closed abruptly on April 15. The annual Muscular Dystrophy Association Tub Run scheduled for June 1st has been cancelled.
